Web accessibility used to be a best practice public bodies could defer. Under the current Title II rule it is a regulatory requirement with population-tiered deadlines, and the cheapest time to meet it is before anyone files a complaint.
The rule
The Department of Justice finalized a rule under ADA Title II requiring state and local government web content and mobile apps to conform to WCAG 2.1 Level AA. This is no longer an interpretation argued case by case: it is a published standard with dates attached. Public entities serving 50,000 or more must conform by April 26, 2027; smaller entities and special district governments have until April 26, 2028.
The exposure
An inaccessible public site invites ADA complaints to the Department of Justice, OCR complaints against school divisions, and private lawsuits. What follows a complaint is remediation on someone else's timeline, with legal cost stacked on top of the engineering cost you would have paid anyway. Entities that fix their sites before a complaint choose the scope, the schedule, and the budget. Entities that wait get all three chosen for them.
The evidence
An Accessibility Conformance Report (ACR, produced from the VPAT template) documents how a site measures against each WCAG success criterion. Procurement asks for one because it is the verifiable evidence of conformance, not a vendor's marketing claim. We deliver an ACR aligned to Section 508 / WCAG 2.1 AA at no additional cost on every procurement engagement.
